Welcome to Ambiee! These Terms of Service ("Terms") govern your use of the Ambiee mobile application ("App"), operated by Sora Forge ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By creating an account or using Ambiee, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Sora Forge.

2. Description of Service

Ambiee is a soundscape and breathing exercise application designed to help users relax, focus, and practice mindfulness through:

Curated ambient sounds and music
Guided breathing exercises
Customizable soundscapes and playlists
Session tracking and preferences

3. Eligibility

The App is available to users of all ages. However:

Users under the age of 13 must have parental or guardian consent to use the App.
Users between 13 and 18 years of age must have their parent or legal guardian review and agree to these Terms on their behalf.
By using the App, you represent and warrant that you meet these eligibility requirements.

4. License to Use

4.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices you own or control.

4.2 Restrictions

You agree not to:

Copy, modify, distribute, sell, or lease any part of the App
Reverse engineer, decompile, or attempt to extract the source code of the App
Remove, alter, or obscure any proprietary notices on the App
Use the App for any illegal or unauthorized purpose
Attempt to gain unauthorized access to any part of the App or its related systems
Use automated scripts, bots, or scrapers to access the App
Interfere with or disrupt the App's servers or networks

5. Premium Subscription

5.1 Subscription Service

Ambiee offers a premium subscription ("Premium") that unlocks additional features, including:

Access to all sounds and playlists
Ad-free experience
Advanced breathing techniques
Exclusive content and features

5.2 Payment and Billing

Premium subscriptions are processed through Apple App Store or Google Play Store In-App Purchase (IAP) systems.
Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
Subscription pricing is displayed in the App and may vary by region.

5.3 Managing Subscriptions

You can manage and cancel your subscriptions by:

iOS: Settings > [Your Name] > Subscriptions
Android: Google Play Store > Menu > Subscriptions

5.4 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will retain Premium access until the end of that period. No refunds will be provided for partial subscription periods.

5.5 Free Trials

We may offer free trial periods for Premium subscriptions. If you do not cancel before the trial period ends, you will be automatically charged for the subscription. Trial eligibility may be limited to new users or determined at our sole discretion.

6. Refund Policy

All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective refund policies:

Apple: Refund requests must be made directly to Apple through reportaproblem.apple.com
Google: Refund requests must be made directly to Google Play within the timeframe specified in their policies

Sora Forge does not have the ability to process refunds directly. Please contact the respective platform's support team for refund inquiries.

7. Advertisements

The free version of Ambiee displays advertisements provided by Google AdMob. By using the free version, you agree to:

View advertisements as part of your app experience
Allow Google AdMob to collect data in accordance with their privacy policy
Understand that ad content is controlled by third-party advertisers

Premium subscribers enjoy an ad-free experience. We are not responsible for the content of third-party advertisements.

8. Intellectual Property

8.1 Our Content

All content in the App, including but not limited to text, graphics, logos, icons, audio clips, digital downloads, and software, is the property of Sora Forge or its content suppliers and is protected by international copyright laws.

8.2 Third-Party Content

The App includes audio content from third-party creators, which is used under free commercial licenses or licenses that do not require attribution. We provide attribution information for these sounds within the App, including:

Artist name
Artist website or profile URL
Sound/track URL

These sounds remain the property of their respective creators and are subject to their original license terms.

8.3 Trademarks

Ambiee and Sora Forge names, logos, and related marks are trademarks of Sora Forge. You may not use these trademarks without our prior written permission.

9. Health and Wellness Disclaimer

Important Health Notice:

Ambiee is designed for relaxation, focus, and wellness purposes. However:

The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Breathing exercises and relaxation techniques are not a substitute for professional medical advice, diagnosis, or treatment.
If you experience dizziness, lightheadedness, or any discomfort during breathing exercises, stop immediately and consult a healthcare professional.
If you have any respiratory conditions, heart problems, or other health concerns, consult your doctor before using breathing exercises.
Always seek the advice of your physician or qualified health provider with any questions about a medical condition.

By using Ambiee, you acknowledge that you use the App at your own risk and that Sora Forge is not liable for any health-related issues that may arise from your use of the App.

10. User Conduct

You agree to use the App in accordance with all applicable laws and regulations. You will not:

Use the App in any way that violates any applicable law or regulation
Engage in any activity that interferes with or disrupts the App or servers
Attempt to impersonate another user or person
Use the App to transmit any viruses, malware, or harmful code
Collect or store personal data about other users without permission
Use the App for any commercial purpose without our written consent

11. Privacy and Data Collection

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our collection and use of data as described in the Privacy Policy.

In summary, we collect:

Device information (platform, device model, device name)
App usage analytics through Firebase Analytics
Crash reports through Firebase Crashlytics
Ad interaction data through Google AdMob

We do not store user accounts or personal data on our servers. All preferences are stored locally on your device.

12. Third-Party Services

The App integrates with the following third-party services:

Firebase Crashlytics: For crash reporting and app stability monitoring
Firebase Analytics: For understanding user engagement and app usage
Google AdMob: For displaying advertisements in the free version
Apple App Store / Google Play Store: For payment processing and subscriptions

These services have their own terms and privacy policies. We are not responsible for the practices of these third-party services.

13. Updates and Changes to the App

We may update, modify, or discontinue the App or any features at any time without notice. We may also impose limits on certain features or restrict access to parts or all of the App without liability.

You may need to update the App to continue using it. Updates may be required for security, bug fixes, or new features. Your continued use of the App after updates constitutes acceptance of any changes.

14. Termination

14.1 Termination by You

You may stop using the App at any time by deleting it from your device. If you have an active subscription, you must cancel it separately through your App Store or Google Play account.

14.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to:

Violation of these Terms
Fraudulent, abusive, or illegal activity
Extended periods of inactivity

14.3 Effect of Termination

Upon termination:

Your right to use the App will immediately cease
You must delete the App from your devices
Active subscriptions may be canceled without refund (subject to platform policies)

15. Disclaimers and Limitations of Liability

15.1 "AS IS" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
That the App will be uninterrupted, timely, secure, or error-free
That defects will be corrected
That the App or servers are free of viruses or harmful components

15.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SORA FORGE SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Damages resulting from your use or inability to use the App
Damages resulting from any unauthorized access to or use of our servers
Health-related issues arising from use of breathing exercises or relaxation features

IN NO EVENT SHALL SORA FORGE'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS LESS.

15.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Sora Forge, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your access to or use of the App
Your violation of these Terms
Your violation of any rights of another party
Your violation of any applicable laws or regulations

17. Dispute Resolution

17.1 Informal Resolution

If you have any concerns or disputes, please contact us first at soraforgehelpdesk@gmail.com. We will attempt to resolve the issue informally within 30 days.

17.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction of residence, without regard to its conflict of law provisions.

17.3 Arbitration

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration body in your jurisdiction, except where prohibited by law.

18. International Use

Ambiee is available globally. If you access the App from outside your home country, you are responsible for compliance with local laws. We make no representation that the App is appropriate or available for use in all locations.

18.1 European Union Users

If you are located in the European Union, you have certain rights under the General Data Protection Regulation (GDPR), including the right to access, correct, or delete your personal data. See our Privacy Policy for more details.

18.2 California Users

If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA). See our Privacy Policy for information about your rights and how to exercise them.

19. Children's Privacy

While Ambiee is suitable for all ages, we do not knowingly collect personal information from children under 13 without parental consent. Since we do not require account creation and do not collect personal data, children can use the App safely. However, parents should supervise their children's use of the App and in-app purchases.

20. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms in the App with a new "Last Updated" date
Sending an in-app notification
Sending an email if we have your contact information

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sora Forge regarding your use of the App and supersede all prior agreements and understandings.

23. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of Sora Forge.

24. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
